NetmarPlus PIN MARKET

This document is provided in English. If we provide a translation, the English version prevails to the extent permitted by the law of your country of residence.

1. Who we are and what these Terms cover

These Terms of Service (the “Terms”, also our user agreement) form a legally binding contract between you and Netmar LLC, a limited liability company organized under the laws of the State of Delaware, USA, with its registered office at 112 Capitol Trail, Suite A3703, Newark, DE 19711, USA (“NetmarPlus”, “we”, “us”). NetmarPlus is a brand of Netmar LLC.

They govern your use of the websites at netmarplus.com and netmarllc.com and any related services (the “Service”), your NetmarPlus account, the NetmarPlus wallet in Türkiye, and every purchase of digital products you make through the Service.

The following documents form part of these Terms: the NetmarPlus Gift Card Terms, the Refund & Withdrawal Policy and the Acceptable Use Policy. Our Privacy Policy and Cookie Policy explain how we handle personal data.

Summary. We are the only seller on NetmarPlus. Outside Türkiye you pay for each order by card on Stripe's secure checkout page; there is no wallet or stored balance. In Türkiye you pay with NetmarPlus wallet balance, added with NetmarPlus Gift Cards from our distributor. Digital codes are delivered immediately. If you live in the EU, EEA or UK, you keep all rights your local consumer law gives you; nothing in these Terms limits them.

2. Definitions

  • Account: your personal NetmarPlus customer account.
  • Card Payment: payment for a single order by bank card or another method offered on the checkout page of our payment service provider Stripe (outside Türkiye).
  • Wallet or Wallet Balance: the euro (EUR) denominated store credit held in an Account registered in Türkiye (shown in the display currency you choose), which can only be used to buy Products on NetmarPlus.
  • NetmarPlus Gift Card: a prepaid, closed-loop store card issued by us and sold only in Türkiye, with a code that adds a fixed value to a Wallet.
  • Product: a digital item offered on NetmarPlus, such as a game activation key, a subscription code or (in Türkiye) an in-game currency code.
  • Platform: the third-party service on which a Product is activated or used (for example a game store, console network or game publisher).
  • Consumer: a natural person acting for purposes outside their trade, business, craft or profession.

3. Eligibility, accounts and verification

You may create an Account and buy Products only if you are at least 18 years old or the age of majority where you live, whichever is higher, and you have full legal capacity. By creating an Account you confirm this.

To register you give your first and last name, a unique user name, your e-mail address, a password and the currency in which you want to see prices. You must give your real name and an e-mail address you control. Each person may hold one Account. You must keep your password confidential and not share your Account. You are responsible for activity in your Account unless it results from our breach or from unauthorized access that you could not reasonably have prevented. Tell us immediately at the support address below if you suspect unauthorized access.

Additional verification. We do not ask for identity documents when you register. To prevent fraud and to meet our legal and payment-network obligations, we may ask you to verify your identity before we add balance, deliver an order or lift a hold, in particular for high-value or unusual activity, after a payment dispute, at the request of our payment service provider, or where the law requires it. What we may ask for and how to send it securely is described in our Account Verification Policy. Until the check is complete we may hold the order or the top-up. If the information cannot be verified, or if we are required to do so by law or sanctions rules, we may cancel the order and refund the amount to the original payment method or your Wallet, and close the Account.

Dealers in Türkiye apply separately and are approved by our distributor; the Toptan (Bayi) Satış Koşulları apply to them.

We may suspend an Account as described in section 14.

4. Payment and the NetmarPlus wallet

How you pay depends on the country registered on your Account.

  • Outside Türkiye: Card Payment for each order. There is no Wallet. You pay for each Product separately on the secure checkout page of our payment service provider Stripe, with a bank card or another method shown for your country (for example Apple Pay, Google Pay, iDEAL, Bancontact, BLIK or Klarna). You pay the amount shown at checkout, in the currency of your country where Stripe supports it, otherwise in US dollars. The contract is concluded when Stripe confirms the payment, and the code is delivered right after. We never see or store your full card details. NetmarPlus Gift Cards, Wallet Balance and other stored value are not offered outside Türkiye.
  • Türkiye: NetmarPlus wallet. Products are paid for only with Wallet Balance, added by redeeming NetmarPlus Gift Cards. Cards are sold by our authorized distributor Netmar Pazarlama Turizm Ticaret İthalat İhracat Limited Şirketi by bank transfer to the distributor’s company account shown in the Wallet. That transfer is a purchase of a Card from the distributor, not a payment to us; when the distributor confirms it, it sends the Card code to your Account e-mail address and shows it in your Wallet. The Türkiye Satış Koşulları apply to those purchases. Card Payment is not available for Accounts registered in Türkiye.

We do not accept cryptocurrency, cash or PayPal. Daily purchase limits apply and are shown before payment.

These rules apply to the Wallet:

  1. You add balance by signing in, opening your Wallet, choosing “Add balance to wallet” and entering a valid NetmarPlus Gift Card code. The face value of the Card is credited to your Wallet in euro.
  2. Wallet Balance is store credit. It is not a bank deposit, e-money or a payment account, earns no interest, is not insured by the FDIC or any deposit guarantee scheme, and cannot be transferred to another Account.
  3. Wallet Balance does not expire and we charge no dormancy, inactivity, service or maintenance fees.
  4. Wallet Balance cannot be withdrawn or exchanged for cash, except where applicable law requires it or as described in the Refund & Withdrawal Policy.
  5. If we credit balance to your Wallet in error, we may correct it. If you have already spent it, we will contact you before taking further action.
Three rules that always apply to NetmarPlus Gift Cards and Wallet Balance:
  • Only on NetmarPlus, only in Türkiye. They can be used only on NetmarPlus (netmarplus.com and netmarllc.com) by Account holders in Türkiye to buy Products sold by us. They cannot be used on any other website, store, app or platform.
  • No cash. Once a Card has been loaded into a Wallet, the balance cannot be converted into cash or withdrawn; see “Cash rules” in the NetmarPlus Gift Card Terms.
  • No trading between members. Cards and Wallet Balance may not be traded, swapped, sold or transferred between members. A Card can be loaded into one Account only, and Wallet Balance always stays in that Account.

Further rules for NetmarPlus Gift Cards are set out in the NetmarPlus Gift Card Terms.

5. Products, regions and Platform rules

Each Product page shows the Product’s main characteristics, including the Platform, the region in which it can be activated (for example “Global”, “US” or “EU”), any denomination and the price.

  • Region restrictions. Many Products work only on Platform accounts registered in a specific region. You are responsible for checking that the Product’s region matches your Platform account before you buy. A Product that works as described but cannot be used because of a region mismatch is not faulty.
  • Platform terms. Products are activated and used on third-party Platforms. Your use of a Product is also subject to the Platform’s own terms, age ratings and system requirements. The Platform, not NetmarPlus, provides the game, content or service you unlock with the Product.
  • No affiliation. Product and Platform names and logos are trademarks of their respective owners. NetmarPlus is an independent reseller and is not endorsed by or affiliated with those owners unless we say so expressly.
  • Licence to codes. A Product gives you the right to redeem the code once on the relevant Platform for your personal, non-commercial use. You may not resell Products or use them commercially without our prior written agreement.

6. Prices, currencies and taxes

Product prices on NetmarPlus are set in US dollars (USD). Your Wallet is kept in euro (EUR): when you buy, the USD price is converted to euro at the exchange rate of that moment (rounded up to the nearest cent) and deducted from your Wallet. Prices and your balance are shown in the display currency you chose when you registered (you can change it in your account settings); amounts in a display currency other than euro are converted at recent exchange rates and are for information. The euro amount deducted is shown before you confirm a purchase.

For Consumers in the EU, EEA and UK, displayed prices include value added tax (VAT) or similar taxes where these apply. Where we are required to account for VAT on supplies to you, we do so under the applicable rules (for example the EU One-Stop-Shop scheme). A crossed-out price next to a Product is the recommended retail price of the Platform or publisher (“RRP”), not a previous NetmarPlus price. Where we announce a price reduction against our own previous price, that previous price is the lowest price we applied in the 30 days before the reduction.

We may change prices at any time, but a change does not affect an order you have already placed. If a Product is shown at an obviously wrong price because of a technical or typographical error, we may cancel the affected order and return the amount to your Wallet.

7. How a contract is made

  1. Product listings are an invitation to make an offer. You make a binding offer when you tick the immediate-delivery confirmation (where shown) and click the buy button on a Product page.
  2. The contract is concluded when we accept your offer by deducting the price from your Wallet and displaying the code to you. If the Product is out of stock at that moment, no contract is formed and no amount is deducted.
  3. Before you buy, you can see the Product details, the price and your Wallet balance after purchase, and you can cancel by closing the window. Errors in your input can be corrected before you click the buy button.
  4. The contract language is English. We store the details of your order in your Account under Wallet → My orders, where you can view them at any time. Where we have enabled order e-mails, we also send you a confirmation by e-mail.

8. Delivery

Products are delivered electronically. The code is shown on screen immediately after purchase and saved in Wallet → My orders. In rare cases (for example, a supplier delay) a code may be marked as pending; we will deliver it without undue delay and in any case within 30 days, or return the amount to your Wallet if we cannot.

Once a code has been displayed, you are responsible for keeping it confidential. We are not responsible for codes that are viewed, copied or redeemed by others because you shared them or because your Account credentials were compromised through no fault of ours.

9. Right of withdrawal (EU, EEA and UK Consumers)

If you are a Consumer resident in the EU, EEA or UK, you generally have a statutory right to withdraw from a distance contract within 14 days without giving any reason.

Digital content delivered immediately. Products are digital content not supplied on a tangible medium. Before you buy, we ask you to expressly request immediate delivery and to acknowledge that you lose your right of withdrawal once the code is delivered. If you give this consent and acknowledgement and we deliver the code, your right of withdrawal ends at delivery (Article 16(m) of Directive 2011/83/EU and the corresponding national laws, including regulation 37 of the UK Consumer Contracts Regulations 2013). We confirm your consent in your order record and, where enabled, by e-mail.

If these conditions are not met, you keep your right of withdrawal. You can exercise it using the “Withdraw from contract here” function in Wallet → My orders, by e-mail, or with the model withdrawal form. Full details are in the Refund & Withdrawal Policy.

10. Faulty codes and legal guarantee

We supply Products that match their description and work on the stated Platform and region. If a code is invalid, already used or otherwise does not work as described, contact support with your order ID. We will check the code with our supplier and, at no cost to you, send a working replacement or, if that is not possible, return the price to your Wallet.

EU, EEA and UK Consumers have statutory rights when digital content is not in conformity with the contract (for example under Directive (EU) 2019/770 and the national laws implementing it, or the UK Consumer Rights Act 2015). These include the right to have the content brought into conformity, to a proportionate price reduction or to end the contract and receive a refund. These rights apply in addition to this section and are not limited by these Terms.

Consumers in the United States and elsewhere: to the extent permitted by law, the remedy described in the first paragraph is your exclusive remedy for a faulty Product.

11. Acceptable use

You agree to use the Service lawfully and in line with the Acceptable Use Policy. In particular, you may not use the Service for fraud, money laundering, to redeem NetmarPlus Gift Cards that were obtained unlawfully, to resell Products without authorization, to access the Service by automated means, or to interfere with its security.

12. Community content

When you share messages, posts, photos or comments in the NetmarPlus community, you keep your rights in them and give us a non-exclusive, worldwide, royalty-free licence to host, store, resize, display and remove them for running the community. The licence ends when you or we delete the content, except for copies we must keep by law. You confirm that you have the right to share what you post and that it follows the Acceptable Use Policy. Content shared by members is not checked before it appears and does not reflect our views. We may remove content and restrict community access as described in the Acceptable Use Policy.

13. Sanctions and export control

You may not use the Service if you are located in, or ordinarily resident in, a country or territory subject to comprehensive U.S., EU or UK sanctions (currently Cuba, Iran, North Korea, Syria, Russia, Belarus and the Crimea, Donetsk and Luhansk regions of Ukraine), or if you are listed on, or owned or controlled by a person listed on, a sanctions list maintained by the U.S. Department of the Treasury (OFAC), the EU, the UK or the United Nations. We may block access, refuse transactions and freeze Wallet Balance to the extent required by sanctions law.

14. Intellectual property

The Service, including its design, text, graphics, the NetmarPlus name and logos and the software behind it, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service for its intended purpose. Product content is owned by the respective Platform or publisher. See our IP & Copyright Policy for how to report infringement.

15. Suspension and termination

By you. You may close your Account at any time in Wallet → Privacy & data, provided your Wallet Balance is zero, or by contacting support. If you have remaining balance, contact support first so that we can help you use it or, where the law requires, refund it.

By us. We may suspend or close your Account, block NetmarPlus Gift Card codes or reverse transactions if we reasonably believe that you have breached these Terms or the Acceptable Use Policy, are involved in fraud or other unlawful activity, or if we are required to do so by law. Where reasonable, we will tell you the reason and give you the opportunity to respond. Wallet Balance that results from fraud or unlawful activity may be withheld.

If we close the Service or your Account for reasons other than your breach, we will give you at least 30 days’ notice where possible so that you can use your Wallet Balance, and we will refund any remaining balance where the law requires it.

16. Disclaimers

Except as expressly stated in these Terms and subject to the mandatory rights of Consumers, the Service is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all implied warranties, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free. We are not responsible for the availability, content or operation of third-party Platforms.

Nothing in this section excludes or limits any warranty or right that cannot be excluded or limited under the law that applies to you, including the statutory rights of EU, EEA and UK Consumers.

17. Limitation of liability

Users outside the EU, EEA and UK. To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill or game progress, arising out of or relating to the Service or these Terms. Our total liability for all claims relating to the Service or these Terms is limited to the greater of (a) the amounts you spent on Products in the 12 months before the event giving rise to the claim and (b) 100 U.S. dollars. Some jurisdictions do not allow these limitations, so they may not apply to you.

EU, EEA and UK Consumers. We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, and under mandatory product liability law. For slight negligence we are liable only for breach of essential contractual obligations (obligations whose fulfilment makes proper performance of the contract possible and on which you may regularly rely), limited to the damage typically foreseeable when the contract was concluded.

Nothing in these Terms limits liability for fraud or for anything that cannot be limited by law.

18. Indemnity

If you are not a Consumer, or where permitted by the law that applies to you, you agree to indemnify us against third-party claims and related reasonable costs arising from your breach of these Terms or your unlawful use of the Service. This section does not apply to Consumers in the EU, EEA or UK.

19. Complaints and dispute resolution

Complaints

Please contact us first at info@netmarplus.net. We aim to reply within 2 business days and to resolve complaints within 14 days.

EU, EEA and UK Consumers

You may bring proceedings in the courts of the country where you live, and the mandatory consumer protection rules of that country apply in addition to the governing law below. The EU Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025. Information on our position regarding alternative dispute resolution is given in the Legal Notice. You may also contact the consumer protection authority or a European Consumer Centre in your country.

United States: binding individual arbitration

Please read this carefully. It affects your rights.

  1. Informal resolution. Before starting arbitration, you and we agree to try to resolve the dispute informally for at least 30 days after one party sends the other a written notice describing the dispute (our address for notices: info@netmarplus.net).
  2. Arbitration. If you live in the United States, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator may award the same individual relief a court could. We will pay the AAA filing, administration and arbitrator fees that exceed the amount you would pay to file in court, unless the arbitrator finds your claim frivolous.
  3. Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court for infringement of intellectual property rights.
  4. Class action waiver. You and we may bring claims only on an individual basis and not as a plaintiff or class member in any purported class, collective or representative proceeding.
  5. Opt-out. You may opt out of this arbitration agreement by e-mailing info@netmarplus.net within 30 days after you first accept these Terms, stating your name, Account e-mail and that you opt out.
  6. If any part of this arbitration section is found unenforceable, the class action waiver remains in force, and if the waiver is found unenforceable, the entire arbitration section is void.

This arbitration agreement does not apply to Consumers resident in the EU, EEA, UK or any other country where pre-dispute arbitration agreements with consumers are not permitted.

20. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules, and, where applicable, the U.S. Federal Arbitration Act. If you are a Consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of habitual residence. The UN Convention on Contracts for the International Sale of Goods does not apply.

Subject to the arbitration section and the rights of Consumers to sue in their home courts, the state and federal courts located in the State of Delaware have exclusive jurisdiction.

21. Changes to these Terms

We may update these Terms to reflect changes in law, our Products or the way we operate. We will give you at least 30 days’ notice of material changes by e-mail or on the Service before they take effect. If you do not agree, you may close your Account before the change takes effect, and we will help you use or, where required, refund your Wallet Balance. Changes do not apply to orders already placed.

22. General

  • Entire agreement. These Terms and the documents referred to in them are the entire agreement between you and us regarding the Service.
  • Severability. If any provision is found invalid, the rest remains in effect.
  • No waiver. Failure to enforce a right is not a waiver of that right.
  • Assignment. You may not transfer your rights under these Terms. We may transfer our rights and obligations to an affiliate or to a successor in connection with a merger or sale, provided your rights as a Consumer are not reduced.
  • Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control, such as Platform outages, network failures or acts of public authorities.
  • Notices. We may send you notices to your Account e-mail address or display them in your Account.
